An Administrative Monetary Penalty System (AMPS) fine can be issued to anyone involved in the cross border movement of commodities who contravenes the rules and regulations found in the Customs Tariff and the Customs Act including importers, exporters, brokers, warehouse and duty free shop operators, carriers, freight forwarders or representatives thereof.
This means that almost everyone involved in a transaction with the Canada Border Services Agency (CBSA), whether it be import, export, transportation or warehousing, must ensure that they are compliant with all of the rules and regulations necessary for their part in the transaction; otherwise they may be subject to an AMPS fine.
